Terms and Conditions
These General Terms and Conditions are valid from 20.04.2019 and are valid until further notice.
General Terms and Conditions (GTC) apply to the online shop (Shop) maintained by Potential Foods Oy and its usage. By purchasing products and by using Potential Food’s online shop you agree to these General Terms and Conditions.

You have to be 18 years old and have a permanent delivery address in the Shop's delivery area to be able to buy from our Shop.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Login and Personal Data
You can browse and use the Shop as well as purchase from the Shop with or without login. You can also create an account as a registered customer. It will make your shopping easier and faster. You are responsible for the confidentiality of your username and password, and you are responsible for purchases made with your personal logins.
Order and Order Confirmation
We try our best to guarantee the availability of all products. However, it may sometimes happen that a product is not available, and we reserve the right not to accept your order. In this case, we are in contact with you to find the best solution.
When ordering you will see the current product prices including VAT. Shipping fee will be calculated based on the value of your order and delivery country. You will see shipping fee for your order in the shopping cart before confirming your order.
Prices and shipping fees are processed in EUR. If there is a clear price error in a product price and it can be assumed that you have understood the mistake, we will contact you and the product price will be corrected.
When selling and delivering products to EU countries, displayed prices include VAT according to Finnish legislation.
When selling and delivering products outside the EU, you as customer are responsible for possible local taxes, customs duties, and other similar costs.
We offer secured payment methods with Stripe, Paypal and Paytrail. If your payment is not confirmed, your order will not be accepted.
With Stripe credit card payments (e.g. Visa, MasterCard and American Express) are processed securely via Stripe gateway. With PayPal you need an own PayPal account when using Paypal as your payment method.
Paytrail Plc acts as a collecting payment service provider and is an authorized Payment Institution. Paytrail Plc will be shown as the recipient on your bank or credit card statement. Paytrail Plc will forward the payment to the merchant. For reclamations, please contact the website the payment was made to. The products will be sent to you once you have made the payment according to the payment terms.
We will process your order during the same or next weekday. However, we use third party contract for the deliveries and this might have an effect on delivery time.
The delivery times are: EU 4-10 days, Finland 2-5 days, and the rest of the world 7-15 days. You can track and trace your product during shipping with the shipping code of your order confirmation.
If you do not pick up your parcel on time, it will return to us. A non-collected parcel is not an order cancelation, so we will charge you for shipping and handling.
The Shop is not responsible for any delays or other damages resulting from force majeure (such as strikes or disruptions in transport).
The destination country (outside EU) may charge VAT or other customs duties which are not included in our prices. You are responsible for these.
You have the right to cancel your order by informing Nosht within 14 days after receiving your order. Contact us according to the instructions below, if you want to make a return.
The cancellation applies to products only if the product packaging is intact and the product is unused. The customer is responsible for return shipping costs. You must, no later than fourteen (14) days from the date of cancellation notice, return the products to us. As you are responsible for the return of the products, make sure that the products are well packed during the shipment.
We will refund received payments or price differences for the cancelled order for the same payment method you used when paying in the Shop. We will also refund the shipping fee for orders if the entire order is cancelled. When cancelling a part of an order, we will charge the shipping fee, which is deducted from the refundable amount.
Please contact us at email@example.com within 14 days after receiving your order. If the product is damaged, wrong or faulty, attach a clear picture of the product and its package to your email. Also include: 1) the order number of the delivery, 2) your name and contact information, and 3) a specification of the product(s) to be returned.
We will reply with further instructions.
Please keep the shipment receipt for at least three months, otherwise we will not take responsibility if the return parcel is lost during the delivery.
Errors and complaints
Please check your order immediately after receiving it to detect possible errors. If your order is missing items or the parcel is otherwise damaged, please notify the Shop immediately by email at firstname.lastname@example.org.
Your notification should include: 1) the order number of the delivery, 2) your name and contact information, and 3) a specification of the defected product(s) and the claimed defect.
In the event of a complaint, the Shop has primarily the right to correct the error. If the error cannot be corrected, the Shop has the right to cancel the order.
Sometimes we use product arrangements in some of our product images. Please read the product description carefully so that everything is clear regarding your ordered product. The Shop may reject the complaint if it turns out that you have purchased the product without familiarizing yourself with the entire product description.
Limitation of Liability
We will not indemnify for indirect damages or other costs relating to indirect damages. Our liability for any direct damage is not more than the price you paid for the product in our Shop.
The content provided at the Site is for information purposes only and is it not intended to substitute medical or other consultation with a qualified professional. We are not responsible if information made available on this site is not accurate, complete or current.
Changes to these General Terms and Conditions
Potential Foods Oy reserves the right to change the GTC. Changes are published in the Shop. By using the Shop you agree to these updated GTC.
Applicable Law and Settlement of Disputes
Finnish law covers these General Terms and Conditions.
All disputes regarding this agreement shall be resolved primarily through discussions between you and Potential Foods Oy. If disagreements between the parties cannot be resolved in discussions, you have the right to refer the matter to the Finnish Consumer Disputes Board. If the dispute or disagreement reaches the court, it will be settled in the District Court of Helsinki.
These terms do not limit your statutory rights.
